DSHEA created a new regime for the regulation of dietary supplements. These products were previously regulated either as foods or as drugs, depending upon whether they had the attributes of food and upon their intended uses. Before the passage of DSHEA, a dietary supplement was regulated either as a drug, which had to be shown to be safe and effective before marketing, or as a food, for which other manufacturing and labeling rules applied.
